Terms of Service

These Terms of Service (“Terms”) govern your access to and use of SubmitMate (the “Service”), a campaign-builder and form-submission platform provided by Kingdom Software, an Australian sole trader business (“Kingdom Software”, “we”, “us”, ABN 73 404 270 785). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of a business, you are agreeing on that business’s behalf and confirm you have authority to do so.
1. The Service
SubmitMate lets you build promotional campaign pages (a drag-and-drop builder of text, image, button and form blocks), publish them, and collect submissions from the public through those pages, subject to any submission limits you configure. SubmitMate is currently in a private, pre-launch (waitlist) stage — features, pricing, and this document will change before general availability, and we’ll notify waitlisted users of material changes before signups open.
2. Accounts
You must be at least 18 years old and provide accurate account information. You are responsible for safeguarding your login credentials and for all activity under your account. Tell us promptly (support@kingdomsoftware.com.au) if you suspect unauthorised use.
3. Acceptable use
You’re responsible for every campaign you publish and every field you configure a form to collect. When using the Service you must not:
- Collect more personal information through a campaign form than you need for that campaign’s stated purpose, or collect sensitive information (health, government IDs, financial account details, etc.) without a lawful basis and your own compliant privacy notice covering that collection.
- Promote or facilitate anything illegal under Australian law, including unlicensed promotions/lotteries, or content that is fraudulent, defamatory, harassing, or infringes someone else’s intellectual property or privacy rights.
- Send unsolicited commercial electronic messages in breach of the Spam Act 2003 (Cth) to anyone who submits to your campaign.
- Attempt to disrupt, scrape, reverse-engineer, or gain unauthorised access to the Service, other tenants’ data, or public campaign submitters’ data outside of the export tools we provide you.
- Impersonate a person or organisation, or misrepresent your affiliation with one.
We may suspend or remove a campaign, or suspend your account, if we reasonably believe it breaches this section — we’ll aim to notify you when we do, except where legally restricted from doing so or where notice would defeat the purpose of the action.
4. Your responsibility for submitter data
As between you and Kingdom Software, you are the data controller for personal information collected through your campaign forms, and we act as your service provider in storing and processing it on your behalf. You warrant that you have the right to collect that data and that your own privacy notice to submitters is accurate. You agree to indemnify us against claims arising from your campaign content or your handling of submitter data outside the Service.
5. Subscriptions & fees
Paid plans, pricing, and billing are not yet live as of this version of the Terms — see our pricing page once published for current plan details. Prices, once published, are quoted in AUD. Kingdom Software is not currently registered for GST; if that changes, GST will be added to invoices and disclosed at the time. Payment (once available) will be processed by a third-party payment processor — we do not store your full card details.
6. Intellectual property
We own the Service itself (the builder, renderer, and underlying software). You retain ownership of the content you upload or create in your campaigns. You grant us a licence to host, store, and display that content solely to operate the Service for you (including rendering your published campaign pages publicly, as they’re designed to be).
7. Availability & support
We aim for the Service to be reliably available but don’t currently offer a contractual uptime guarantee (SLA). We may modify or discontinue features with reasonable notice where practical.
8. Termination
You may stop using the Service and close your account at any time by contacting support@kingdomsoftware.com.au. We may suspend or terminate your access for a material breach of these Terms, including Section 3, or for non-payment of fees once billing is live. On termination, see our Privacy Policy for how long your data is retained.
9. Limitation of liability
To the maximum extent permitted by law, and subject to any consumer guarantees under the Australian Consumer Law that cannot be excluded, Kingdom Software’s total liability arising from these Terms or the Service is limited to the amount you paid us for the Service in the 12 months before the claim arose. We are not liable for indirect, consequential, or special losses.
10. Governing law
These Terms are governed by the laws of Victoria, Australia.
11. Changes to these Terms
We may update these Terms from time to time. We’ll post the updated version here with a new “Last updated” date, and for material changes we’ll make reasonable efforts to notify account holders directly.
